Introduction
These Terms of Service (“Terms”) govern your access to and use of Functional Idaho websites, apps, facilities, programs, and services (collectively, the “Services”). By using the Services, you agree to these Terms and all policies incorporated by reference, including our Privacy Policy at https://www.functionalidaho.com/privacy-policy. If you do not agree, do not use the Services.
1.Acceptance of Terms
By creating an account, booking or purchasing, entering the facility, or participating in any on-premises, off-site, outdoor, travel-related, or virtual activity, you agree to these Terms. If you accept on behalf of a company or a minor, you represent you have legal authority to do so.
2.Who We Are; Terminology
Functional Idaho (“JCF,” “we,” “us,” or “our”) is a Boise, Idaho fitness center offering 24/7 facility access, personal coaching, small-group classes, nutrition support, and online/virtual programs. We use “Partner” rather than “Member.” In these Terms, “Partner,” “client,” and “you” refer to the individual using the Services (or the parent/guardian, where applicable).
3. Eligibility and Accounts
- Age. You must be at least 18 to agree to these Terms. Minors may participate only with a parent/guardian’s consent and completion of all required youth waivers and consents. Additional age limits may apply to equipment/areas.
- Account Security. Keep your credentials confidential. You are responsible for account activity. Notify us promptly of unauthorized access.
- Accurate Information. Provide and maintain accurate contact and billing information.
4.Health and Medical
- Not Medical Advice. Coaching, class content, website information, and nutrition guidance are educational/fitness-oriented only and are not medical advice. Always consult a physician before beginning or modifying exercise or nutrition programs.
- Physical Readiness. You confirm you are fit to participate and will disclose relevant medical conditions or restrictions. You accept inherent risks associated with physical activity.
5.Facility Access, Security, and Technology
- 24/7 Access. Eligible Partners may be issued credentials for after-hours access. We may use secure access controls (e.g., key or biometric) consistent with our Privacy Policy.
- Safety and Video. For safety and loss prevention, certain areas may be monitored by video (no monitoring in restrooms/locker rooms).
- Compliance. Follow posted rules and staff instructions. We may suspend or revoke access for safety or policy violations.
6.Conduct, Safety, and Club Rules
- Respect. Treat staff and Partners with dignity. No harassment, threats, discrimination, or unsafe behavior.
- Equipment and Cleanliness. Wipe down equipment; re-rack weights; follow signage and coaching instructions.
- Prohibited Activities. No smoking/vaping, illegal drugs, intoxication, or unauthorized commercial use.
- Lockers and Property. Day-use lockers are provided when available. We are not responsible for lost, stolen, or damaged property. Use a personal lock and limit valuables.
- Filming/Recording. Do not film or record others without permission. Tripods or rigs require prior approval.
7.Youth and Minors
- Supervision and Consent. Parent/guardian must execute all youth participation waivers and consents. Youth must follow staff instructions; additional area/equipment restrictions apply.
- Off-Premises/Virtual Coverage. Required youth waivers extend to JCF-led activities on-site, off-site, outdoors, during travel, and virtual formats.
- Children’s Area. If provided, additional posted rules apply. Parents/guardians remain responsible for their children at all times.
8.Media and Testimonial; Opt-Out
- Consent. By entering our facility or participating in JCF activities, you consent to photography, video, and audio that may include you (or your child) for marketing, educational, and promotional purposes without compensation, as outlined in our Privacy Policy and Waiver.
- Opt-Out Process. To request an opt-out from routine marketing capture, you must complete all events on the Summit Wall process prior to participation. Instructions are posted at the facility. Opt-out does not apply to security video, incidental background capture in public settings, or uses required by law.
9.Scheduling, Cancellations, No-Shows, Day-Pass
- Bookings. Sessions, classes, assessments, and events may require advance booking through designated platforms.
- Late Cancellation and No-Show. Unless a program states otherwise, cancellations must be made at least 24 hours in advance. Late cancels/no-shows may incur a fee up to $100 or the retail value of the missed service.
- Day-Pass. Any usage within a 24-hour period may incur a day-pass fee up to $100 (certain promotions may alter the final fee as posted).
10.Billing, Recurring Payments, and Disputes
- Recurring Authorization. By purchasing recurring services, you authorize ongoing charges to the payment method on file until canceled under these Terms.
- Price Changes. We may change prices with reasonable notice. New prices apply at the next billing cycle after notice.
- Refunds and Credits. All sales are final unless expressly stated. At our discretion, account credits or transfers may be issued.
- Disputes/Chargebacks. You agree to contact us first to resolve billing issues. Where a separate Credit Card Authorization and Dispute Waiver applies, it is incorporated by reference (including any administrative fee for improper chargebacks).
- Taxes/Fees. Prices may not include applicable taxes or third-party platform fees.
11.Changes/Cancellations by You; Verification Requirement
- Notice Window. To cancel or change recurring services, you must provide written notice at least 21 business days before the intended change date (or as otherwise required by applicable program terms or law).
- Identity-Verification Form. To initiate any cancellation or change, you must request JCF’s identity-verification form through a phone call or other live, human interaction (e.g., in-person). Email-only requests are not accepted, except where prohibited by law. Your request is effective only after we receive your correctly completed verification form and supporting ID.
- Method of Submission. We will provide instructions for secure submission when you request the form.
- Effect of Use During Notice Period. Using Services during a pending cancellation/change may result in charges consistent with the current plan until the change is effective.
12.Freezes/Holds (protective baseline)
- Discretionary. Freezes are not guaranteed and are granted at JCF’s discretion, except where required by law.
- Eligibility. Generally limited to verified medical conditions or active-duty military orders. Documentation is required.
- Duration and Limits. Minimum freeze length is 30 days; maximum total is 3 consecutive months within any 12-month period.
- Fees. A freeze fee of $25 per month (or portion) applies unless prohibited by law.
- Billing and Term. Freezes are not retroactive. Billing automatically resumes on the scheduled unfreeze date. Any minimum-term commitment is extended by the length of the freeze.
- Access During Freeze. Accessing the facility or using services during a freeze terminates the freeze and reinstates regular billing.
13.Online/Virtual Services and Digital Content
- Third-Party Platforms. Some programming uses third-party platforms or apps subject to their own terms; your use is at your discretion and risk.
- Technology. You are responsible for devices, connectivity, and data charges. Availability may vary.
- Limited License. We grant a limited, non-exclusive, non-transferable license for personal, non-commercial use of our digital content and materials. Reverse engineering, scraping, or unauthorized distribution is prohibited.
- Recording. Do not record, broadcast, or share classes/sessions without our written consent.
14.Intellectual Property
All websites, apps, workouts, programs, videos, graphics, text, and trademarks are owned by JCF or its licensors and protected by law. You may not copy, modify, distribute, display, or create derivative works without written permission.
15.Third-Party Links and Integrations
The Services may link to or integrate third-party websites or software. We are not responsible for third-party content, availability, or practices. Your use is subject to those parties’ terms and policies.
16.Privacy and Communications
- Privacy Policy. Our Privacy Policy describes how we collect, use, disclose, and safeguard personal information. By using the Services, you consent to those practices. See: https://www.functionalidaho.com/privacy-policy
- Communications. You consent to service-related emails/SMS (e.g., confirmations, reminders, account notices). Message/data rates may apply. Opt-out of marketing messages per the Privacy Policy.
17.Disclaimers and Assumption of Risk
- Fitness Risks. You understand and assume the inherent risks of physical activity and facility use, including serious injury or death, and agree to follow safety rules and instructions.
- “As Is.” The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- Results. We do not guarantee specific fitness outcomes.
18.Limitation of Liability
To the maximum extent permitted by law, JCF and its owners, officers, employees, agents, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; for loss of profits, data, goodwill, or business interruption; or for any claims exceeding the amounts you paid to JCF for Services in the six (6) months preceding the event giving rise to liability. Some jurisdictions do not allow certain limitations; parts of this section may not apply.
19.Indemnification
You agree to defend, indemnify, and hold harmless JCF and its owners, employees, agents, and contractors from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of: (i) your use of the Services; (ii) your violation of these Terms or policies; (iii) your negligence or willful misconduct; or (iv) claims related to any minor in your care.
20.Dispute Resolution; Governing Law; Venue
- Faith-Based Mediation First. In the event of a dispute, the parties will first engage in good-faith Christian mediation consistent with biblical principles. If unresolved within [30] days of a written request for mediation, the dispute proceeds to binding arbitration.
- Binding Arbitration; Class Waiver. Except for small-claims matters, disputes shall be resolved by final, binding, individual arbitration under the Federal Arbitration Act and the Consumer Arbitration Rules of the American Arbitration Association (AAA). Class actions and class arbitrations are waived. Each party bears its own attorneys’ fees and costs unless the arbitrator awards otherwise or applicable law provides.
- Seat/Venue and Law. The seat of arbitration is Ada County, Idaho. These Terms are governed by Idaho law, without regard to conflict-of-laws rules. Subject to arbitration, courts in Ada County, Idaho have exclusive jurisdiction for permitted proceedings.
- Time to File. Any claim must be filed within one (1) year after it arose, unless prohibited by law.
21.Promotions, Trials, and Gift Cards
Promotions and trials may carry additional terms at purchase. Unless specified otherwise, promotions are one-time, non-transferable, and may be modified or discontinued at our discretion.
22.Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, public health emergencies, labor disputes, supply interruptions, or government actions.
23.Modifications to Terms
We may modify these Terms at any time. Changes are effective upon posting with an updated “Last Updated” date. For recurring services, material changes will be communicated with reasonable notice. Continued use after changes take effect constitutes acceptance.
24.Severability; Assignment; Entire Agreement; No Waiver
If any provision is unenforceable, the remaining provisions remain in effect. You may not assign these Terms without our consent; we may assign as part of a reorganization or sale. These Terms, together with incorporated policies (Privacy Policy, posted program terms, waivers), form the entire agreement. Failure to enforce a provision is not a waiver.
